| Property Division |
|
Divorces end the marital union of two people and the commingling of their property. Property acquired during the marriage is subject to a division between spouses, under the China marriage laws granting the divorce.
A prenuptial agreement may protect certain property in case of divorce. For example, if a wife purchases a house during marriage, she might be entitled to keep it after divorce under the terms of a prenuptial agreement. Without a prenuptial agreement, the property might be sold and the proceeds divided between the parties.
In most cases the parties each will receive an equal share. In some cases courts award equitable shares - not necessarily equal shares. An equitable share may give one spouse more or less than half of the property depending on a number of factors like length of marriage, conduct during marriage, contribution toward the acquisition and preservation of the property, income, education, health, age, and so forth.
An experienced divorce lawyer helps you by identifying and valuing property, and then negotiating or litigating for the best possible outcome. |
